1. Introduction
These Terms of Service ("Terms") govern your access to and use of FoxVault's data storage and encryption application ("Service"), including all associated content, features, and any future additions related to the Service. By creating an account, accessing, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, you must stop using the Service immediately. These Terms form a legally binding agreement between you and Digital Galleon, LLC. (“we,” “us,” or “our”).
2. Definitions
- "Service" refers to the FoxVault application, website, and all related features or services.
- "User" refers to anyone accessing or using the Service.
- "Content" refers to any data, files, or information uploaded, stored, or transferred using the Service.
- "Account" refers to a User’s personal access credentials for the Service.
- "Sensitive Data" refers to any encrypted data the User chooses to store, such as credentials, 2FA keys, passwords, private notes, or other personal information.
- "Zero-Knowledge Principle" Refers to FoxVault's policy that ensures only the User has access to their encrypted data. We cannot access your data under any circumstances.
3. Eligibility
3.1. Age Requirement
You must be at least 18 years old to access or use the Service.
3.2. Minor Users
Users aged 13–17 may use the Service under the direct supervision of a parent or legal guardian who agrees to these
Terms on their behalf.
3.3. Legal Authority
By using the Service, you represent and warrant that you meet the applicable age requirements and have the legal
authority to accept these Terms.
4. Use of the Service
4.1. Lawful Use
You agree to use the Service only for lawful purposes and in accordance with these Terms.
4.2. Prohibited Activities
You may not misuse the Service by introducing viruses, accessing unauthorized areas, or engaging in activities that
disrupt the Service.
4.3. Account Requirement
If you access the Service without creating an account (e.g., as an incognito user), you agree to comply with all
applicable laws and these Terms. However, certain features may require an account, and your access may be limited.
5. User Responsibilities
5.1. Account Security
You are responsible for maintaining the confidentiality of your account credentials, including passwords and encryption
keys.
5.2. Compliance with Laws
You must ensure that any data or content you upload complies with applicable laws and does not infringe on the rights of
others.
5.3. Backup Responsibility
You are solely responsible for regularly backing up your data to prevent accidental loss.
5.4. Responsibility for Minor Users
If you allow a minor to use the Service, you are responsible for their activity and compliance with these Terms.
6. Data Security
6.1. Zero-Knowledge Encryption:
All sensitive data is encrypted locally on your device before being stored. We cannot
access your data under any circumstances, ensuring that you retain full control and privacy.
6.2. Data Storage
Sensitive data is encrypted on your device and, if backed up, in the cloud. Only subscribed users'
data will be stored in the cloud, and this data is encrypted following the same Zero-Knowledge Principle.
6.3. Offline Functionality
Data synchronization can be performed completely offline. Your data remains available
offline, and you can continue to use the Service without an internet connection, ensuring complete privacy.
6.4. Data Transmission You acknowledge that no method of data transmission over the internet is completely secure. While we take reasonable measures to protect your data, absolute security cannot be guaranteed.
7. Payments and Subscriptions
7.1. Subscription and Payments
Some features of the Service require a subscription or one-time payment. Payments are processed securely through
third-party providers like Stripe.
7.2. Refunds
All payments are generally non-refundable. However, refunds may be issued under the following conditions:
- If you experience a technical issue preventing access to the Service, and we are unable to resolve it within a reasonable time.
- If you accidentally purchase a subscription and request a refund within 7 days of purchase, provided you have not used the Service significantly during this time.
- For yearly subscriptions, refunds may be issued on a pro-rata basis if you cancel within the first 30 days.
7.3. Refund Requests
Refund requests are subject to review and approval by our support team. Abuse of the refund policy (e.g., repeated
cancellations) may result in the denial of future refunds.
8. Termination
8.1. Termination by Us
We may terminate or suspend your account if you violate these Terms or engage in unauthorized activities.
8.2. Termination Consequences
Upon termination, your access to the Service will cease, and any associated data may be permanently deleted.

You may terminate your account at any time through the account settings in the app.
9. Limitation of Liability
9.1. No Guarantee
FoxVault is provided “as is” and “as available.” We do not guarantee uninterrupted or error-free Service.
9.2. Warranty Disclaimer
To the fullest extent permitted by law, FoxVault disclaims all warranties, whether express or implied.
9.3. Limitation of Liability
FoxVault is not liable for any loss or damage resulting from:
- Unauthorized access to your account.
- User error in securing passwords or encryption keys.
- Service interruptions or technical failures.
10. Governing Law and Jurisdiction
10.1. Governing Law
These Terms are governed by the laws of Florida, United States, without regard to conflict of law principles.
10.2. Disputes and Jurisdiction
Any disputes or legal proceedings related to these Terms or the Service must be brought in the courts located in
Florida, United States.
11. Updates and Modifications
11.1. Modification of Terms
FoxVault reserves the right to modify these Terms at its sole discretion.
11.2. Notification of Changes
For significant changes, we will notify you via email or an in-app alert at least 30 days in advance.
11.3. Continued Use
Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
